1. Acceptance of Terms
By accessing and using BlockSign Asset Operations services provided by BlockSign GmbH, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Description of Service
BlockSign Asset Operations, operated by BlockSign GmbH, provides an institutional-grade Digital Asset Operations Platform for enterprises, including HD, MPC-Shamir, MPC-FROST, and Hardware wallet models, multi-signature transaction approvals, role-based access control, and multi-chain support for Bitcoin, Cardano, Midnight, and EVM chains (Ethereum, Polygon, Solana).
3. User Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Ensuring compliance with applicable laws and regulations
- Proper use of multi-signature approvals and security features
- Safeguarding private keys and recovery phrases
4. Security and Compliance
Our platform is designed to be MiCA-compliant. Users must adhere to all regulatory requirements applicable to their jurisdiction when using blockchain services.
5. Non-Custodial Wallets
For non-custodial wallet services, we do not have access to your private keys. The following applies:
- HD Wallets & Shamir MPC Wallets: We store a three-layer encrypted version of the recovery phrase solely for disaster recovery purposes.
- FROST MPC Wallets: We store encrypted key fragments solely for disaster recovery purposes.
- Hardware Wallets: We store no key material whatsoever. All keys remain exclusively on your hardware device.
- Recovery Assistance: Upon a legitimized request (such as death of key holder, court order, or verified identity recovery), we may assist in restoring access to your wallet as an extra service offered as a measure of last resort. However, we are not responsible for the outcome of any recovery attempt, and this service is provided without any guarantee of success.
6. Custodial Wallets
For custodial wallet services, the following applies:
- We do not have access to your private keys. Key material is transferred through a secure, encrypted communication channel to NBX (Norwegian Block Exchange).
- HD Wallets & Shamir MPC Wallets: A three-layer encrypted version of the recovery phrase is transferred to and stored by NBX. FROST MPC Wallets: Encrypted key fragments are transferred to and stored by NBX.
- NBX (Norwegian Block Exchange) is a licensed and regulated entity that stores all key material in cold storage systems with institutional-grade security.
- You can request recovery assistance directly from NBX without our involvement or assistance being necessary. NBX maintains independent recovery procedures.
7. Payments and Subscriptions
Subscription payments are processed through Stripe:
- All credit card payments are processed securely through Stripe, a PCI-DSS Level 1 certified payment processor.
- Subscriptions are billed on a recurring basis according to your selected plan (monthly or annual).
- You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
- Refunds are handled in accordance with our refund policy and applicable consumer protection laws.
8. Disaster Recovery Procedures
We maintain comprehensive disaster recovery procedures that are activated under specific conditions:
- DR procedures are triggered by: key material exposure, loss of signing quorum, governance integrity issues, or platform outages affecting signing operations.
- Incidents are classified into escalation levels (L0-L4) with appropriate response procedures for each severity level.
- All recovery operations involving key material require multi-party authorization including Admin, Reviewer, and Guardian approvals as defined in our operational policies.
- We maintain defined Recovery Time Objectives (RTO) and Recovery Point Objectives (RPO) for each incident category to ensure timely restoration of services.
9. Limitation of Liability
BlockSign GmbH shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your access to or use of, or inability to access or use, the service.
10. Modifications to Service
We reserve the right to modify or discontinue, temporarily or permanently, the service with or without notice. You agree that BlockSign GmbH shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the service.
11. Governing Law
These terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. Place of jurisdiction is Düsseldorf, Germany.
